By accessing or using BabyGuard ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service, including but not limited to the mobile application, website, and any related services.

BabyGuard is an AI-powered mobile application and web service that provides information about product ingredient safety during pregnancy. The Service includes:

• Product ingredient scanning and analysis
• Safety information based on scientific research
• Alternative product suggestions
• Educational content about pregnancy safety
• Data storage and history tracking

The Service is for informational purposes only and does not constitute medical advice.

BabyGuard is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition or pregnancy.

Never disregard professional medical advice or delay in seeking it because of something you have read or accessed through BabyGuard. If you think you may have a medical emergency, call your doctor or emergency services immediately.

BabyGuard does not recommend or endorse any specific tests, physicians, products, procedures, opinions, or other information that may be mentioned in the Service.

To access certain features of the Service, you must register for an account. When you register:

• You must provide accurate, complete, and current information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized use of your account
• You must be at least 13 years old to use the Service

BabyGuard offers different subscription plans:

• Free Trial: 3 complimentary scans to try the Service
• Monthly Subscription: $4.99 per month
• Annual Subscription: $39.99 per year
• Lifetime Access: One-time payment of $99

All payments are processed through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis. You may cancel your subscription at any time through your account settings.

Refund Policy: We offer a 30-day money-back guarantee on all paid subscriptions. Contact support@babyguard.app for refund requests.

The Service and its original content, features, and functionality are owned by BabyGuard, Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not:

• Copy, modify, or distribute the Service's content without permission
• Use the Service for commercial purposes without authorization
• Reverse engineer or attempt to extract the source code
• Create derivative works based on the Service

By submitting content to BabyGuard (including product scans, reviews, or feedback), you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute such content in connection with the Service.

You represent and warrant that your content does not violate any third-party rights and complies with all applicable laws.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

We are committed to protecting your privacy and comply with applicable data protection laws, including GDPR and CCPA where applicable.

You may not use the Service to:

• Violate any applicable laws or regulations
• Transmit any harmful or malicious code
• Attempt to gain unauthorized access to the Service
• Harass, abuse, or harm other users
• Provide false or misleading information
• Scrape or harvest data from the Service
• Interfere with the proper functioning of the Service

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BABYGUARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

In no event shall BabyGuard's total liability exceed the amount paid by you to BabyGuard in the twelve (12) months preceding the claim.

You agree to defend, indemnify, and hold harmless BabyGuard, its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any harm resulting from your reliance on information provided by the Service

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in San Francisco, California.
